TERMS AND CONDITIONS

Welcome to Mini Mavericks Sports Centre (operated by Mini Mavericks Inc.)! We are delighted to provide sports programs and services for children in a safe and engaging environment.

These Terms and Conditions govern your participation in our programs, events, and bookings. By enrolling in a program or purchasing any services, you acknowledge and agree to these terms. If you do not agree, you should not participate in or purchase any of our services.

PLEASE READ CAREFULLY BEFORE PARTICIPATING.

SECTION 1: DEFINITIONS

For the purposes of this Agreement:

  • “Act of God” means any event outside human control, including but not limited to natural disasters, floods, fires, power failures, pandemics, government restrictions, or facility closures.
  • “Child” or “Participant” means the individual enrolled in Mini Mavericks programs.
  • “Coach” means an individual employed by Mini Mavericks to deliver the Services.
  • “Course” or “Program” means the Mini Mavericks program you are attending or enrolling in.
  • “Drop-Off” means a program where a Child is left under the supervision of Mini Mavericks Coaches.
  • “Enrolment Form” means the online form completed by a Parent to register a Child.
  • “Event” means a Mini Mavericks program session.
  • “Fee” means the monetary cost per Course/Program.
  • “Mini Mavericks” (also known as “Mini Mavericks Inc.” or “Mini Mavericks Sports Centre”) refers to the company providing the Services.
  • “New Customers” means children whose parents/guardians are attending a Mini Mavericks class for the first time.
  • “Parent” or “Guardian” refers to the legal guardian responsible for payment and agreement to these Terms.
  • “Parent-Required” means a Parent/Guardian is required to actively monitor and participate alongside their Child.
  • “Premises” means the venue where a Course/Program takes place.
  • “Private Event” means a privately booked Mini Mavericks session (e.g., birthday parties).
  • “Season” means the 12-week term of the Course/Program a Participant is enrolled in.
  • “Services” means any Mini Mavericks program, event, membership, or merchandise.
  • “Terms” means these Terms and Conditions.
  • “Writing” for the purposes of these Terms, includes digital communications such as emails.
  • “You” or “Your” means the person purchasing Services and their affiliates.
  • “Your Data” means electronic data and information submitted by or for you to the Services.
 

SECTION 2: OUR RESPONSIBILITIES

 

2.1 Provide the Services

Mini Mavericks and its Coaches will provide the Services as described at the time of purchase and will do so with reasonable skill, care, and diligence.

2.2 Protection of Your Data

We will implement safeguards to protect the security, confidentiality, and integrity of Your Data.

2.3 Our Personnel

We are responsible for ensuring our staff and contractors comply with our obligations under these Terms.

2.4 Safety

  • All Coaches eligible for a Vulnerable Sector Check will have an up-to-date police background check.
  • At least one Coach per Event/Program session will be certified in First Aid and CPR.
  • A First Aid kit will always be on-site.

2.5 No Guarantee of Results

Mini Mavericks does not guarantee specific skill improvements, fitness outcomes, or performance results.

SECTION 3: REGISTRATION & PROGRAM POLICY

 

3.1 Registration

  • All registrations are subject to availability and must be completed via the official Mini Mavericks website, app or at our facility.
  • Registration is only confirmed once payment is received (i.e. deposit, partial payment, or full payment).

3.2 Drop-Off Programs

  • Parents/Guardians must ensure their child is signed in and out of each session.
  • If an individual other than the Parent/Guardian will pick up the child, prior written notice must be provided.

3.3 Parent-Required Program

A Parent/Guardian must actively participate and keep their Child within eyesight at all times.

3.4 Age & Ability Requirements

  • Each program has specific age and ability requirements. It is the responsibility of the Parent/Guardian to ensure the Participant is eligible.
  • By enrolling your Child into a Mini Mavericks Program, you are confirming that you and/or your Child are physically, emotionally, and mentally fit to participate.

3.5 Code of Conduct

  • Parents/Guardians are responsible for their Child’s behaviour.
  • Mini Mavericks reserves the right to suspend or cancel a Child’s and/or Parents participation without refund if their behavior is deemed unsafe or disruptive to others.
 

SECTION 4: PAYMENT, CANCELLATION & REFUND POLICY

 

4.1 Payment

  • Program Fees: All fees are in Canadian dollars and subject to applicable taxes and service charges.
  • Payment must be made in full and in advance.
  • Payment Methods: We accept Visa, MasterCard, and other payment methods as specified on our website.
  • Failed Payments: If a payment fails, you must rectify the issue promptly to avoid cancellation of enrolment.

4.2 Cancellation & Refunds

  • Full Refund: If you notify us within 24 hours of the first class that your child will not continue, a full refund (excluding service fees) will be provided.
  • Partial Refund: Cancellations made in writing at least 30 days before the last class will receive a prorated refund for remaining sessions.
  • No Refunds: Refunds will not be issued for cancellations within 30 days of the final Program session.
  • Medical or Special Circumstances: Refunds will be considered case-by-case (documentation may be required).
  • Private Events: Unless requested in writing at least 30 days in advance of your private event booking, your event will be non-refundable. However, it may be rescheduled once with 7 days’ written notice. Private events must be rescheduled within 60 days of the original event and can only be rescheduled once.

4.3 Program Modifications & Cancellations

  • Mini Mavericks Inc. reserves the right to reschedule, modify, or cancel programs due to unforeseen circumstances, including but not limited to low enrolment, facility availability, or public health concerns. In such cases, a full refund or alternative Program placement will be offered.
  • Full refunds will be processed within 15 business days.

4.4 Attendance Policy

  • No refunds or make-up sessions will be provided for missed classes due to illness, travel, or personal reasons.

4.5 Refunds in Special Circumstances

Refunds may be granted at Mini Mavericks’ discretion for medical or special cases.

SECTION 5: MEDIA & COMMUNICATION CONSENT

5.1 Image & Media Release

  • By participating, you consent to Mini Mavericks using photos/videos of your child in promotional materials.
  • If you do not wish for your child to be photographed or recorded, you must submit a written request prior to program start.

5.2 Personal Data Protection

  • All personal information is securely stored and used only for program-related purposes in compliance with PIPEDA (Personal Information Protection and Electronic Documents Act).
  • Data will not be shared with third parties without explicit consent.

5.3 Communication Consent

  • You consent to receiving program-related communications via email, SMS, or other digital channels.
  • You may withdraw consent at any time by notifying Mini Mavericks in writing.
 

SECTION 6: LIABILITY, INDEMNITY, HEALTH & SAFETY

6.1 Assumption of Risk

You acknowledge that sports and recreational activities involve inherent risks, including property damage, injury, and/or death. By enrolling, you waive any claims against Mini Mavericks Inc. arising from injury, illness, death, or damages, whether caused by negligence or otherwise.

6.2 Release of Liability

  • You release Mini Mavericks, its staff, and affiliates from any claims arising from injuries, illnesses (e.g., COVID-19), or damages sustained during participation.
  • Mini Mavericks Inc. is not responsible for lost or stolen personal belongings at any facility or program location.

6.3 Indemnity

You agree to indemnify Mini Mavericks from legal claims arising from participation.

6.4 Medical Disclosure

  • Parents/Guardians must disclose any medical conditions that could affect their Child’s participation

  • Mini Mavericks staff are not authorized to administer medication, except in emergency situations.

6.5 Emergency Medical Care
  • In case of an emergency, Mini Mavericks will seek medical attention for the Participant as needed, unless Parents advise otherwise.

  • Parents/Guardians will be responsible for any associated medical costs, beyond basic first aid.

6.6 Acknowledgment of Rowan’s Law (Concussion Safety)

You agree to review Ontario’s Concussion Awareness Resources annually.

SECTION 7: FORCE MAJEURE (ACT OF GOD CLAUSE)

Mini Mavericks Inc. shall not be liable for failure to provide services due to unforeseen events beyond reasonable control, including but not limited to natural disasters, strikes, or government regulations.

SECTION 8: GENERAL TERMS


8.1 Governing Law

These Terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.

8.2 Amendments

Mini Mavericks may update these Terms at any time. Changes will be posted on our website and emailed to customers.

8.3 Termination of Services

We reserve the right to terminate participation for:

  • Failure to pay fees.
  • Breach of Terms.
  • Disruptive behaviour.

9. AGREEMENT ACCEPTANCE

By enrolling your child in a Mini Mavericks program or making any payment, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
